Welcome to Smiro Studio. By accessing or placing an order through our website, you agree to be bound by the following terms and conditions. Please read them carefully.

1. About Us

Smiro Studio operates as a fine jewellery brand with entities in both Canada (Smiro Studio Canada) and the United States (Smiro Studio USA). All of our pieces are handcrafted in Toronto by our team of skilled artisans. These Terms apply to all purchases made through our website regardless of your location.

2. Eligibility

You must be at least 18 years of age to place an order with Smiro Studio. By placing an order, you represent and warrant that you meet this age requirement.

3. Products

All of our pieces are made-to-order, crafted specifically for each customer. Product images are representative and slight variations in colour or finish may occur due to monitor settings or the handcrafted nature of our work. Engagement and wedding rings with stones 1 carat or larger include IGI Certification. As natural stones vary in colour and inclusions, minor variations from reference images are inherent and not considered defects.

4. Custom Orders, Deposits & Cancellations

Custom and made-to-order pieces follow a multi-step process: complimentary estimate, design consultation, 3D CAD approval, and handcrafting. Once a rendering deposit or diamond sourcing deposit has been made, the order cannot be cancelled and the deposit is non-refundable. Production begins only after you have reviewed and approved the final design. Once design approval is given, the full order is non-refundable and no changes can be made. Custom rings typically take 10 to 14 weeks from consultation to completion. Made-to-order pieces have an estimated delivery window of approximately 8 weeks. All timelines are estimates and not guaranteed.

5. Chargeback Waiver

By approving your final design and completing payment, you acknowledge that the item is custom-made to your specifications. You expressly waive your right to initiate a chargeback or payment dispute with your bank or credit card provider. All approved designs and completed payments are final.

6. Pricing, Currency & Quote Validity

Prices are listed in the currency shown at checkout. Custom estimates and quotes are valid for 30 days from the date issued. After this period, pricing may be subject to change due to fluctuations in material costs. Smiro Studio reserves the right to update pricing at any time prior to a deposit being made.

8. Warranty

We offer a one-year limited warranty covering manufacturing defects, excluding the centre stone. The warranty is valid for the original purchaser only and is non-transferable. Proof of purchase is required. Third-party repairs or alterations will void the warranty. Within the warranty period, Smiro Studio covers all shipping costs. Outside the warranty period, shipping costs are the client’s responsibility. See our Warranty page for complete terms.

9. Ethical Sourcing

We follow the Kimberley Process and work exclusively with suppliers who provide detailed origin documentation and certifications. All diamonds are conflict-free.

10. Shipping, Duties & Tariffs

We ship internationally. All shipments require a signature upon delivery. Estimated delivery times are provided at checkout and are not guaranteed. Smiro Studio is not responsible for delays caused by carriers, customs, or circumstances beyond our control.

The client is solely responsible for providing an accurate shipping address. Smiro Studio is not liable for lost, delayed, or undelivered packages resulting from an incorrect address.

All applicable customs duties, import taxes, tariffs, and brokerage fees for international shipments are the sole responsibility of the client. Smiro Studio is not responsible for any charges levied by your country’s customs authority. Smiro Studio is not responsible for lost or stolen packages once delivery has been confirmed by the carrier.

11. Intellectual Property & Design Ownership

All content on this website — including designs, images, text, and branding — is the property of Smiro Studio and may not be reproduced or used without prior written consent. All CAD files, 3D renderings, and custom designs created by Smiro Studio remain the exclusive intellectual property of Smiro Studio, regardless of whether a purchase is completed.

12. Force Majeure

Smiro Studio shall not be held liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, supply chain disruptions, labour disputes, pandemics, or government restrictions. In such cases, we will communicate updated timelines as soon as reasonably possible.

13. Limitation of Liability

To the maximum extent permitted by law, Smiro Studio shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website. Our total liability shall not exceed the amount paid for the specific order in question.

14. Privacy

Your personal information is collected and used in accordance with our Privacy Policy. By using our website, you consent to the collection and use of your information as described therein.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.

16. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our website after changes are posted constitutes acceptance of the revised Terms.
